Terms of Use

1. Agreement Between You and the Developer

These Terms of Use (the "Agreement") form a binding contract between you (the "User") and the developer of Teremok, Volodymyr Perelyhin (the "Developer"). This Agreement governs your use of the Teremok mobile application (the "App") and any associated services.

Apple Inc. is not a party to this Agreement. The Developer, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to provide any maintenance or support services for the App.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not install or use the App.

2. Licence Scope

The Developer grants you a non-transferable, non-exclusive, revocable licence to use the App on any Apple-branded device that you own or control, in accordance with the Apple Media Services Terms of Service and the Usage Rules set out in the App Store Terms.

The licence is tied to the Apple ID used to obtain the App and may be used only on devices linked to that Apple ID. You may not copy (except as permitted by this licence and the Usage Rules), modify, translate, decompile, reverse-engineer, disassemble, attempt to derive the source code of, or create derivative works of the App.

3. Subscriptions and Lifetime Unlock

Teremok offers the following optional in-app purchases:

• Annual Subscription — auto-renewing. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period. Renewal is charged to your account within 24 hours prior to the end of the current period.
• Lifetime Unlock — a single non-consumable in-app purchase that unlocks the App's premium features for the lifetime of the App on the purchasing Apple ID.

All payments are processed by Apple through your Apple ID. The Developer does not receive your payment details. You can manage and cancel subscriptions at any time in Settings → Apple ID → Subscriptions on your iOS device. Once a period has been paid for, it is not possible to cancel mid-cycle — this is Apple's standard policy. Refund requests are governed by Apple's refund policy and must be submitted to Apple at reportaproblem.apple.com.

4. No Medical Advice

Teremok is not a medical device. The App provides general environmental and wellness information (weather, air quality, UV index, biometeorological factors, and a personalised Wellness Index) for informational purposes only. The App does not diagnose, treat, cure, prevent, or mitigate any disease or medical condition.

The Wellness Index, recommendations, and any other content displayed by the App do not constitute medical advice and are not a substitute for professional medical consultation, diagnosis, or treatment. Always seek the advice of a qualified physician or other healthcare professional with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App.

5. Warranty Disclaimer

The App is provided "as is" and "as available", without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and quiet enjoyment.

The Developer does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, that the data displayed (weather, air quality, etc.) is accurate or complete, or that the App or the servers it relies on are free of viruses or other harmful components. Use of the App is at your sole risk.

Apple-required clause: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of, or inability to use, the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if the Developer has been advised of the possibility of such damages.

The Developer's total cumulative liability arising out of or relating to this Agreement or the App shall not exceed the amount you have paid for the App or the relevant in-app purchase in the twelve (12) months preceding the claim.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

9. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Beneficiary (Apple)

You and the Developer acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

11. Account Termination

The Developer may suspend or terminate your access to the App at any time, with or without cause, including but not limited to violations of this Agreement. You may stop using the App at any time by deleting it from your device. Termination does not entitle you to a refund of any subscription fees already paid; refund handling is governed by Apple's policy.

12. Changes to These Terms

The Developer may revise this Agreement from time to time. The revised version will be posted at this URL with an updated effective date. Your continued use of the App after changes become effective constitutes acceptance of the revised terms. Material changes will be communicated via in-app notification when reasonably practicable.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the competent courts of Thailand, except that Apple-required clauses (Sections 5, 7, 8, and 10) shall be governed and interpreted in a manner consistent with the Apple Developer Program License Agreement.

The above choice of law does not deprive consumers of the protection afforded to them by mandatory provisions of the law of the country in which they reside.
